Booking
With his/her registration/booking of Kamafari Surfcamp Bali, the participant offers us the conclusion of a travel contract engagingly.
Once we receive the booking request, we will, depending on availability, send the booking confirmation in PDF with an invoice or other text form to our participant.
With successful delivery of the booking confirmation the customer is liable to his/her travel booking.
This confirmation (all attendants will be listed) will only be send to the tour leader.
Please check the confirmation carefully after receipt. Contact us immediately if the booking confirmation is faulty or incomplete.
We are not responsible for any errors in the issued document, unless errors were cause by us.
Payment
Unless otherwise agreed, the full invoice amount is due for payment 10 days after receipt of the invoice.
Booking Changes
Please contact us immediately for any changes regarding the confirmed booking reservation.
By changing the number of participants, the total cost of the booking will be reevaluated.
Reduction of participants may cause financial damage for Kamafari, in such case the customer has to reimburse Kamafari for such financial losses.
Changes of reservations on site can only be accepted depending on availability – customer has to pay all costs incurred.
Booking Cancellation
Please contact us immediately in case of a cancellation.
Following Cancellation Fees apply:
– More than 60 days before departure, 20 % of total amount invoiced
– Less than 60 days before departure, 100 % of total amount invoiced
With every cancellation affecting the number of participants, the total amount invoiced will get reevaluated/recalculated and the customer will receive an updated invoice.
Conditions of Participation
The customer explicitly declares that from a medical perspective there are no concerns in participating surfing or any other activity.
It is down to the participant with a medical condition to check with his/her doctor to find out if surfing/surf fitness is within the customers physical and or mental parameters.
Participation in all activities and surfing lessons is undertaken at the customer’s own risk.
The stay at Kamafari Surfcamp Bali is only permitted for people of 18 years or older.
In exceptional cases a special arrangement between Kamafari Surfcamp Bali, the minor and the minor’s legal guardian can be made.
Arrangement of additional services through Kamafari Surfcamp Bali
If Kamafari makes arrangements for the customer with any third party to provide any additional services, such as car rentals, airfare, etc. the terms and conditions of Kamafari will apply.
The accomplishment of the mediated contract and its content conforms to the relevant legal regulations and where applicable to the conditions of the contractual partner, when they are defined as part of the contract or they refer to the contract.
Liability
The operator is not responsible for accidents, traffic obstacles, and delays of the means of transport, the consequent postponement of fixed dates and for any additional costs arising for the participant.
Participation of surf lessons or other activities, the transportation and travel to the destination, and other use of services as well as the stay is done at ones own risk and responsibility.
Kamafari is not responsible and liable for danger the is inevitably connected to surfing or other activities and have been deliberately accepted by the customer.
Furthermore Kamafari is not responsible and liable for any damages or injuries of the customer caused by other participants or third parties during surfing or other activities.
There is no liability for any loss or damages of the customer’s belongings on the part of Kamafari.
Surf equipment, all sports equipment as well as any other objects belonging to Kamafari Surfcamp Bali are to be treated in a regular manner.
The customer has to take full liability for damages caused by negligence and losses.
Liability Limitations
In the case of losses, which exclude bodily injury, Kamafari’s liability is limited in scope to instances of gross negligence and deliberate actions. This includes instances when the customer suffers losses due to the fault of Kamafari’s service. Kamafari’s liability is limited in value in such cases to triple the amount of travel price.
Insurance
Travel cancellation insurance is not included in the price. We recommend the conclusion of such, as well as luggage and travel health insurance.
Changes of Events/Activities
Modification or changes of the course of an event/activity cannot be ruled out.
Especially in case of wave shortage or danger caused by weather conditions the course of an event – such as surf lessons or other activities – might get changed or an alternate program might get offered.
In such cases the customer is not entitled to claim for proportionate or full reimbursement of the travel costs / price.
Exclusion of Claims / Limitation of Actions
The customer is obliged to assert claims regarding deficient travel services, belated impossibility and neglect of additional duties within one month after the contractual termination of the journey.
After the expiration of this deadline, claims can only be asserted if the customer was unable to adhere to the deadline without actual fault.
Claims of the participant expire one year after the contractually intended end of the trip.
Passport, Visa and Health Regulations
Kamafari is not liable for political or health risks of countries to or through which the customers travel. Kamafari is not liable for loss or damage which my accure at the destination. We deeply recommend to comply with any travel bans, take warnings seriously and follow the directions of governmental institutions.
It is the party leader’s responsibility to ensure that all members of the party are in possession of all necessary travel and health documents before departure. Furthermore it is his/her responsibility to ensure that all members meet the health requirements.
The participants must pay all costs incurred in obtaining such documentation. We assume no liability if the party leader or a member of the party are refused entry onto any transportation or into any country due to failure on your part to carry correct and necessary documentation.
The participants must check visa and passport requirements of the country/-ies to or through which they are travelling, and if necessary check with Embassy or Consulate.
Kamafari is not responsible in case of fines, surcharges or other financial penalties, which may accrue due to failure of the customer of having any necessary travel documents
Please be aware that safety standards differ from country to country.
We deeply recommend all customers to inform themselves of the specific laws and regulations governing the countries of the planned journey.
Additionally, the customer should request information about infections and vaccinations as well as other prophylaxis measures and get medical advice if necessary for eg. thrombosis and other health risks. Information to this is given by departments of public health, physicians, tropics institutes, the Foreign Office, etc
Use of Pictures, Data and Data Protection
The participant consents that he/she will be photographed during events and activities and that Kamafari will use those pictures for marketing purposes.
You can revoke this agreement in writing anytime.
The customer agrees that the collected data will be used for purposes of market research and advertising.
With regard to the registered data of the participants Kamafari shall be obligated to observe legal data protection and media law stipulations. In particular we will treat your data confidentially. The participant is authorized to revoke this consent in written form at any time.
Severability Clause
The ineffectiveness of single regulations does not justify the ineffectiveness of the rest of the travel contract.
